1. Acceptance of Terms

By accessing this website or using our coaching and consulting services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old to use our services or website. By using our services, you represent that you are legally eligible to enter into this agreement.

3. Services Offered

Rick Kutcher Consulting, LLC provides the following services:

• One-on-one and group public speaking coaching

• Leadership development consulting

• Workshops, online resources, and training

• Speaking engagements

All services are subject to availability and may change or be discontinued without notice.

4. Booking & Payment

Coaching Sessions:

• Sessions must be booked in advance via our website or designated scheduling platform.

• Full payment is required at the time of booking unless otherwise agreed in writing.

Payments:

• Payments are processed securely through third-party platforms (e.g., Stripe, PayPal).

• The Client agrees to provide accurate billing and payment information and authorizes all charges associated with their bookings.

5. Refund & Guarantee Policy

5.1 Coaching Programs, Packages, and Workshops

• The Client may cancel their purchase within 24 hours of the initial transaction and receive a full refund, less a 5% transaction processing fee.

• If the Client initiates and completes the first coaching session, and subsequently determines the program is not a suitable fit, they may request a full refund for any remaining sessions minus a 5% transaction processing fee. This request must be submitted in writing to info@rickkutcherconsulting.com within 48 hours of the first session.

• Refund requests for custom workshops, corporate trainings, or speaking engagements are not guaranteed and will be considered on a case-by-case basis, depending on the scope of the engagement and the preparation already completed. All cancellation requests must be submitted in writing.

• Once all six (6) sessions of the Command the Room coaching program have been completed, no refund requests will be accepted under any circumstance. Clients are encouraged to review the Satisfaction Guarantee policy below for options related to ongoing support and continued coaching.

• All communication regarding refund requests, cancellations, or program modifications must be submitted in writing via email to info@rickkutcherconsulting.com.

5.2 Flexible Commitment Policy

• The Command the Room coaching program is structured as a six-week engagement, optimized to deliver a comprehensive client transformation. However, Rick Kutcher Consulting, LLC recognizes that every Client’s development path may differ.

• The Client is not obligated to complete all six sessions if they feel prepared before the program concludes. In such cases, a prorated refund will be issued for any unused sessions.

• If the Client anticipates requiring fewer than six sessions, this must be discussed and agreed upon with Rick Kutcher during the initial strategy consultation and confirmed prior to session scheduling.

• Clients who wish to continue coaching beyond the initial six-week program may do so at a discounted rate, as part of our extended support offering.

5.3 Satisfaction Guarantee

• If the Client does not feel significantly more confident or prepared in their communication abilities by the end of the program, Rick Kutcher will provide continued coaching at no additional cost until the agreed-upon communication goals are reasonably met.

• The Client is entitled to one (1) 30-minute “panic call” during the course of the coaching program to provide last-minute preparation and support ahead of a high-stakes meeting, presentation, or speaking engagement.

5.4 Additional Refund & Termination Provisions

• Rick Kutcher Consulting, LLC reserves the right to modify or terminate services or the Client–Company relationship at any time, for reasons including but not limited to:

  • Dangerous, disruptive, or unlawful behavior by the Client

  • Inappropriate, offensive, or abusive conduct

  • Repeated irresponsibility or disrespect toward the coaching process

In such cases, the Client will be notified in writing, and the termination or modification will take effect immediately on the date of notification. At the sole discretion of Rick Kutcher Consulting, a refund may or may not be issued for any remaining sessions or services paid for but not completed.

6. Intellectual Property

All content on this website—including videos, worksheets, articles, branding, and training materials—is the property of Rick Kutcher Consulting, LLC unless otherwise stated.

You may not:

• Copy, reproduce, modify, or distribute our content without written permission

• Use our materials for commercial purposes unless licensed to do so

7. User Conduct

You agree to use our website and services respectfully and lawfully. You must not:

• Post or transmit harmful, abusive, or unlawful content

• Attempt to access or interfere with secure areas of the website

• Impersonate another person or provide false information

8. Disclaimer of Warranties

Our services and website content are provided “as is” and without warranties of any kind. While we aim to provide helpful, high-quality coaching and guidance, we make no guarantees about specific results or outcomes.

9. Coaching Disclaimer

Coaching is a process of personal and professional development and is not a substitute for therapy, medical, legal, or financial advice. You are responsible for your own decisions, actions, and results.

10. Limitation of Liability

To the fullest extent permitted by law, Rick Kutcher Consulting, LLC will not be liable for any direct, indirect, incidental, or consequential damages resulting from:

• Use or inability to use our website or services

• Any action taken based on coaching advice or content provided

• Delays, disruptions, or loss of access

11. Privacy

Your use of our website and services is also governed by our Privacy Policy (link to your privacy page), which explains how we collect, use, and protect your personal information.

12. Third-Party Services & Links

We may use third-party services or include links to third-party websites. We are not responsible for their content, accuracy, or privacy practices.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes will be handled in the courts of Williamson County, Texas.
